By Canna Law Blog on April 25, 2014 Posted in Legal Issues, Medical Cannabis, Washington The Washington State Court of Appeals just held that medical marijuana activity (even patient cultivation in the home) is illegal under current State law. The long road to this disappointing decision began a couple of years ago when an access point (essentially a medical outlet for medical marijuana patients) and an advocacy group sued the city of Kent in an effort to block the city from implementing a zoning ordinance that would essentially prohibit collective gardens, both commercial and home grows. The case made its way through King County Superior Court (which upheld Kent’s ban) and eventually reached the Washington State Supreme Court. The Supreme Court issued an emergency stay of the Kent ban but ultimately decided to send it back down to the Court of Appeals for a full decision on the merits. As I've said before, this slant towards recreational use, has taken the focus off of cannabis as medicine. I'm afraid you might be right kak. When I said I was against it, people looked at me like I was crazy. I am absolutely not against recreational use, but most sick people I know, are also poor. How can they afford to go to a dispensary? When they raised fees for the program in Oregon, I cried foul because the money was not going back into the program, but into something sponsored for the special interests of one of the committee members. Nothing to do with cannabis, drug abuse, or anything health related. To me this was a tax. Those in charge really did not view it as medicine. Do they put a tax on any other medicine?
